K-3/K-4 Visas - Spouses of U.S. Citizens

To become eligible for K-3 visa applicant must satisfy the following requirements:

1. Must have a valid marriage with a U.S. Citizen

2. The U.S. Citizen spouse has already filed the I-130 family petition on behalf of the K-3 applicant

3. K-3 applicant enters the United States to wait for the approval of the I-130 petition

K-3 visas are family related visas issued to spouses of U.S. Citizens, where the unmarried children of K-3 are given derivative status of K-4. Although the K-3 applicant initially enters as a nonimmigrant, he or she can become lawful permanent resident by filing an adjustment of status application sponsored only by the U.S. Citizen spouse who petitioned for the K-3 status.

K-3 status will terminate upon denial or revocation of the I-130 petition, denial or revocation of the adjustment of status or the K-3's divorce from the U.S. Citizen. K-4 status will terminate upon marriage of the child.

K-3 and K-4 are allowed to work in the United States upon applying and receiving an employment authorization document.
